Terms for custom web development and technical delivery.
This page sets out the binding contract for custom web development, maintenance, platform handover, technical agency, and special-case delivery requirements for KrillaBytes WebSites.
1. Intellectual Property

1.1 Licence
The Client is granted a Project Licence to use the site until payment completes, at which point the project is the Clients after completion. -
1.2 Portability
Handover may be via Repository Transfer or a Validated .ZIP archive, which constitutes full legal delivery.

1.3 AI Disclosure
Elements of the code may be AI-assisted; the Developer warrants the right to license these elements for the project. No code written will be entirely written by AI and its general use will be for reducing repetitive tasks. No sensitive data will be given to AI.
2. Client Content & Indemnity

2.1 Responsibility
The Client warrants they own, or have licences for, all text, images, and logos provided for the build.

2.2 Indemnity
The Client indemnifies and holds harmless the Developer against all copyright claims or legal suits arising from material provided by the Client.
3. Maintenance & Subscriptions (DMCC 2024)

3.1 Loyalty Reward
A Loyalty Discount of applies from Month 13 onwards.

3.2 Cancellation
A 14-day cooling-off period applies to new plans. We provide renewal reminders 14-30 days before any major term changes.
4. Technical Infrastructure & Agency

4.1 DPA Authority
The Client appoints the Developer as an Agent to accept standard Data Processing Addendums (DPAs) from Cloudflare, GitHub, and Stripe on their behalf. Other services may be used as necessarry for your project and will require the Client's consent.

4.2 Email Routing
Cloudflare forwarding is used at the Client’s risk regarding third-party spam filters or delivery failures.
5. High-Sensitivity Addendum
For high-risk projects, Cloudflare forwarding is disabled. Dedicated encrypted mail, such as Google Workspace, is mandatory. We provide a Technical Data Map to support the Client’s mandatory DPIA.
